Union Buster Aaron Tulencik and Labor Management Consultants Hired by 13 Employers, Violate Disclosure Rules

Labor Management Consultants and its union buster, Aaron Tulencik, have failed to disclose their anti-worker arrangements with employers in a timely manner. Tulencik and Labor Management Consultants were recently disclosed being hired by 13 employers in California, Colorado, Indiana, Minnesota, Missouri, Ohio, and Pennsylvania, targeting various unions including the International Association of Machinists and Aerospace Workers (IAM), the Service Employees International Union (SEIU), and the United Food & Commercial Workers Union (UFCW).

Under federal law, union busters are required to disclose their activities within thirty days. However, Labor Management Consultants failed to meet this deadline, joining the ranks of over 80% of union busters who violate the timeliness rule. Many union busters never file at all, exploiting a loophole that allows them to avoid disclosure by claiming they only provided "advice" to employers.

Critics argue that the advice loophole undermines workers' right to unionize and should be closed. They call for the reinstatement of the Persuader Rule, which would require union busters to disclose all anti-union activities, including indirect persuasion and advice, to the Department of Labor. As union busting continues to undermine workers' rights across the country, advocates say it is more important than ever to ensure that union busters are held accountable for their actions.
