GFL Environmental USA Inc., a leading waste management company, is now under scrutiny after it was revealed that the company entered into an agreement with JF Management & Consulting LLC for conducting anti-union activities. The controversy arose when JF Management & Consulting LLC filed their disclosure with the U.S. Department of Labor a staggering 82 days after the required deadline, as mandated by the Labor Management Reporting and Disclosure Act (LMRDA).
The agreement between GFL Environmental and JF Management & Consulting LLC was executed on January 19, 2023, marking the company's apparent intention to engage in activities aimed at discouraging workers from organizing or joining labor unions. However, it was only 112 days later that JF Management & Consulting LLC finally submitted the necessary paperwork to the U.S. Department of Labor. The LMRDA stipulates that such disclosures must be filed within 30 days of entering into an agreement, ensuring transparency and providing workers with the information they need to make informed decisions regarding their union rights.
Late filing of anti-union activity disclosures raises concerns about GFL Environmental's commitment to labor rights and its compliance with legal requirements. The delayed submission has denied workers the opportunity to promptly access critical information that could impact their decision-making process when it comes to organizing and participating in collective bargaining activities.
Labor advocates and worker rights organizations are calling for stricter enforcement of disclosure deadlines to ensure that workers have ample time to evaluate their options and exercise their rights in a fair and informed manner.
