In 2020, Gerald O'Brien & Associates was hired by FSCX, Inc. to union-bust training instructors organizing with Machinists & Aerospace Workers in Texas.
FSCX, Inc., which is based in Oklahoma, hired union-buster Gerald O'Brien, based in Minnesota, to "persuade" employees against forming a union. According to records examined by LaborLab, O'Brien started his work on October 29, 2020. However, Gerald O'Brien & Associates didn't file the legally required paperwork until February 17, 2022.
Unfortunately, Gerald O'Brien & Associates' abuse of the law is common due to the fact that there are almost no consequences for union-busters who don't follow the law and file the appropriate paperwork (an LM-20). As a result, the relationship between Gerald O'Brien & Associates and FSCX, Inc. went unreported for over a year.
